Mayberry Park resident vents about loud music

A MAYBERRY Park resident is at her wits’ end and claims loud music from a local bar keeps her family up all night.
She said they were deprived of sleep by “night club” South African Cuisine Kitchen and Bar at Mayberry Park Shopping Centre.
She alleged that the bar has been troubling residents for months and nothing was being done to resolve the matter.
“I wake up at 4am every day to get to work in Sandton. This is unacceptable.
“My only hope is to try and reach a forum that has the power to actually assist us to do something about it.
“I won’t even touch on legalities around the paper work of allowing such an establishment to operate in a residential area,” she said.
When the RECORD spoke to Tholo Mazibuko, owner of South African Cuisine Kitchen and Bar, she extended her apologies to the nearby residents.
“We apologise to community members who may have been affected by our music.
“We held an event on August 15, which may have brought up the complaint. Soon after the local SAPS came and informed us about the complaint we stopped the music and closed,” she said.
She also said they take pride in serving the community because they are part of them and regard themselves as a peaceful restaurant.
“We are not running a night club, but a restaurant. At the request from customers from Mayberry Park and surrounding areas, we host events.
“To safeguard us from similar complaints in future, if events are hosted it will be done at a convenient time with minimal music while also putting the residents first,” she added.

How to report noise disturbances:
Section 8 of the Municipal By-Laws states the following:
Prohibition of disturbing noise
No person shall make, produce or cause a disturbing noise, or allow it to be made, produced or caused by any person, animal, machine, device or apparatus or any combination thereof.
Section 9
Prohibition of noise nuisance
No person shall operate or play, or allow to be operated or played, a radio, television set, drum, musical instrument, sound amplifier, loudspeaker system or similar device producing, reproducing or amplifying sound so as to cause a noise nuisance.
If you are faced with any of these problems in your neighbourhood, as neighbours you need to have an open discussion with the “noise polluter” to either stop or reduce the noise levels to acceptable quietness.
