The ABC of Aarto system

Under the Aarto system traffic, offenders will be awarded up to 12 demerit points after which their licence will be suspended.

With President Cyril Ramaphosa signing the Administrative Adjudication of Road Traffic Offences Act (Aarto Bill), the details of how the new Aaarto system will work has become clear. The bill is due to be gazetted and then sent for review.

The Aarto system works on points added to the licence of traffic offenders. Drivers start with zero points on their licence and whenever an offence is committed demerit points are added, up to a total of 12 points. Once 12 points has been surpassed, the licence of the person will be suspended for three months for every point over the limit. Should the licence be suspended for the third time, it will be cancelled.

Demerit points are recorded when the driver pays fees and penalties, when they apply to pay instalments, when they are found guilty in court or when an enforcement order is issued against them. Demerit points will be reduced by one point for every three months that a driver does not incur any further demerit points.

Under the bill, any driver reserves the right to appeal or review the demerit points recorded against their name.
