Labour court declares SAMWU strike illegal

South African Municipal Workers Union (SAMWU) will not be protected by the law should they go ahead with the planned strike action.

ALBERTON – Ekurhuleni Metropolitan Municipality wishes to inform residents that the planned march by SAMWU staff members for February 14 is illegal and unprotected.

The Labour Court has declared the planned march or strike illegal, unprotected and interdicted the march or strike.

It is important to note that in terms of section 68 (5) of the Labour Relations Act of 1997, an employer is authorised to discipline and dismiss staff who participate in an illegal, unlawful strike.

Ekurhuleni made the statement after informing residents that the municipality had made plans to continue providing them with services while the strike continues.
